Dear Retire OPM, it has been six months since you received my retirement claim, five months since you acknowledged it, and four months since I turned 62. On April 12, 2023 you assigned a CSA number (see attached). On Aug 3, 2023, you wrote in the below email that my claim was recently sent to the Customer Inquiries Branch to be processed, again, because you unlawfully denied my claim . Another six weeks have passed. When will I be paid? Will my back pay include interest? Your delay is causing severe financial harm and hardship for my family. Why are you continuing to delay my payments? Why are you retaliating against me for blowing the whistle on government abuse?
Also, do you have an update on my August 2, 2023 OFFICIAL COMPLAINT FOR OPM SUPERVISORS concerning an employee identified as Kristi G. @opm.gov? Did you investigate Ms. G. or did you turn a blind eye to whistleblower retaliation at OPM?
Bottom Line: Will I be paid my retirement benefits on October 1, 2023? If not, when will I be paid?

Please ensure that the Legal Reconsideration Section personnel assigned to my case are provided with this communication from me to the NLRB that I made today to assist them. It will also be helpful if the analyst assigned my case communicates directly with me by phone and email and not exclusively through the U.S. postal service. It will certainly speed things up, is more efficient and costs less in time and resources. It also helps prevent ‘rework’ which is what is happening right now and will continue to happen until your system is updated.
Dear Legal Reconsideration Branch– The point of contact (POC) for you at the National Labor Relations Board (NLRB) is Inspector General David Berry and Attorney Elizabeth Bach. You will see Ms. Bach’s signature on the attached settlement agreement. If you reach out to her I am sure she can clear things up quickly and get you whatever you need since you already have all the documents that prove I am entitled to retirement pay and, according to Jonnie B, this is a computer systems issue and not a question of my entitlement to retirement pay.

Description: OPM Employees named Kimberly B. AND Jonnie B at the retire@opm.gov organization have informed me that the NLRB did not comply with the attached MSPB settlement for my retirement at 5 years and 1 month even though I have supplied them with all the records to support it.
Before I file a complaint of your non-compliance with the settlement with the MSPB and a complaint to my Senator Rubio for continuous whistleblower retaliation, I wish to obey the settlement agreement. I believe that you want to follow it too. If you can please have someone contact retire@OPM.gov on my behalf and offer your assistance to resolve this issue of non-compliance with the settlement and restore my benefits, that would be a big help.
If not, I guess I’ll be filing. Please let me know if you will help – email imieguy@gmail.com. Attorney Elizabeth Bach or Inspector General David Berry should be up to speed on it. The settlement was for me to be entitled to retirement pay at 62. I think everything was done properly, but OPM says their system shows nothing. It was the whole point of the settlement. Now those benefits are being denied to me unlawfully.

This is an official complaint against employee Kristi G. for malfeasance and ABUSE of authority AND a request for an immediate reassignment and status of my retirement application in order to avoid additional an unlawful WASTE of time and resources processing my valid, complete, and certified application. Perhaps Kristi G. is covering up fraud for herself or others from past years. I do not know why she is behaving so irrationally and aggressively to deny my benefits, but it is clear that she is, it is documented below, and I feel must be addressed before official charges are filed with Congress and your IG by me that should have been corrected by her supervisors long before it reached this point.
Please consider the following facts in your evaluation of Kristi G.’s performance and professionalism while handling my application along with the expected financial and emotional distress her irrational, unprofessional, and unsupported conduct is causing my family at this time. If I do not receive a constructive response from you today addressing this complaint by COB today, I will send this email to my members of Congress and your IG tomorrow and let them work it out for me because I know I am entitled to the retirement pay that you are unlawfully denying me and will eventually get paid. I am a disabled USMC Vet with 25+ years total military and civilian service. I have never been treated so abruptly and unprofessionally by a U.S. government employee concerning an application for benefits in my lifetime. If this person worked for me in federal service, I would be embarrassed if a senior citizen contacted me with this complaint.
Here is a brief summary the documentation again (attached) THAT YOU ALREADY HAVE that demonstrates unequivocally that I am entitled to retirement pay at age 62, completed 5 years and 1 month of creditable service, and paid all my retirement deductions that have been certified correct and have been sent to OPM via a Register of Separations. There are no records of any contribution payments to me in any of my bank accounts, ever. I am 62 yrs old. I have 5+years creditable service for federal retirement, and I made all my retirement contributions to OPM that are certified in a letter. I have applied for and supplied you with all the documentation you need to pay me my retirement pay. Case closed.
Relevant Facts:
On March 10, 2023 I submitted my attached application along with other docs for deferred or postponed retirement which included all my SF50’s AND a letter certifying that my retirement deductions were withheld (attached). Some of the documents I submitted with my application were not requested by you, but were provided to help substantiate my claim for retirement pay and expedite your processing of my payments. My feeling in March was that my application was so detailed and thorough, a young child could process it. Based on the experience so far, I was wrong. A child cannot process it, only a rational adult can.
On April 19, 2023 you sent me the attached letter acknowledging my application and welcoming me to the retirement system and assigning me a CSA number.
On July 6, 2023, Brad H. responded with this email (below) writing, “We received your application and it was assigned to a Legal Admin Specialist on 6/2/23; DEFERRED retirements are currently taking 4-6 months to process; your password is auto-generated and will come in the mail 2 weeks after your first payment is received. Additionally, you will receive retroactive payments from the date that you turned 62.”
On July 31, 2023, I received the attached unsigned FORM letter in the U.S. mail dated July 12, 2023 in an unsealed envelope sent from DC to Florida, that states that you are denying my application because you said, “You were not at your MRA at separation 62 yrs.” That statement makes no sense and is not what the law requires. The form letter you sent looks like something a scammer would send, misspelled my last name, etc. in an open envelope. Normally, your letters are in tamper resistant envelopes. This one was not. As you know, you do not have to be 62 when you separate with 5 or more years creditable service to be eligible, hence the words ‘deferred’ on the application. I am 62 years old. I have 5+years creditable service for federal retirement, and I made all my retirement contributions to OPM that are certified in a letter. Case closed.
Also on July 31, 2023, I emailed retire@opm.gov to complain about the absurd July 12 letter referenced above, and in response to my complaint about the absurdity of being denied retirement because I am 62 (see below), Kristi G. IGNORED MY COMPLAINT about the letter completely and responded (below) instead with a NEW REASON TO DENY MY BENEFITS with a DIRECT REFERENCE in her email to the actual payment codes that are used in the letter that I provided in my original application and sent to her again in my complaint yesterday that certifies that my retirement deductions were withheld and how they were paid to OPM. The letter certifies that the payments Kristi G. says were made to me were in fact made to OPM. The letter says it. For some reason, however, Kristi G. wants to create a reality in her mind that the payments made to OPM were payments to me, but that is false as the documentation proves, and yet another absurd reason to deny my claim. I am 62 yrs old. I have 5+years creditable service for federal retirement, and I made all my retirement contributions to OPM that are certified in a letter. Case closed.
Finally, to answer Kristi G.’s latest email below from this morning alleging yet another excuse to delay my payments, there was no refund application included, submitted or paid by OPM or anyone else to me so there is nothing to mail you. I cannot submit documents for payments to me that do not exist in reality but appear to be present only in the unstable mind of the processor Kristi G. for no good reason. It looks like she is just making up reasons, in rapid fire fashion, one after the other, to deny my claim and delay my payments without any professional consideration or supervision, such as writing to me and saying, “Mr. Edwards, I have these specific issues I need to clear up.” Instead, she is making up absurd reasons one after the other, using form letters and emails to hide her agenda and shield her from accountability; and each time I refute her ridiculous accusations that are unsubstantiated, unlawful, and exist nowhere in reality except her mind, she makes up a new excuse to cause distress for my family and delay of my benefits. I know you folks in DC are nuts, but really. This person needs some serious professional help.
I hope to hear back from you today, but if I don’t I’m sure you’ll be hearing from my elected representatives and the IG sometime after tomorrow. A signed copy of this email is also attached for your file so that you have it with my signature certifying that the information I am providing is correct when someone contacts you and that you have seen my complaints.

In the end, I know that you will eventually be ordered to honor this nation’s commitment to its civil servants and veterans for benefits and not entertain fantasies and charades by employees that obviously are intended to delay payments. If you are going to continue on this charade to make it painful for me, then I will find a way to make it painful for you, starting with the IG, members of Congress and the media until you follow the law.
It’s your choice now. If I lied on my application, my signature on the application and this letter can put me in jail. You know that already so why the delays? What disciplinary action will Kristi G. face for her conduct? A promotion or slap on the wrist?
If you are good supervisors you’ll handle this expeditiously and internally so that I can get on with my retirement. If not, I’ll find someone else who will make you follow the law and stop denying my benefits that are irrational and vindictive.
It is entirely up to you.

Good morning, I turned 62 on June 2, 2023 with 5 years 1 month creditable service for deferred retirement, submitted my application, and Brad H. notified me on Jul 6 (below) that you were processing my application and to expect it to take 4-6 months. Today, I received the attached letter from OPM denying my application because it says that I am not 62? I am 62. I really don’t understand what is going on here. My social security payments started last month because I’m 62 and have already started being paid. What on earth is this all about? I am a government whistleblower that was retaliated against which is why I left service. Please tell me this is not retaliation but instead an administrative error that you will correct for me by saying, “Ignore the letter, we have everything we need to process your retirement application.” It just doesn’t make any sense. Does it make sense to you? Help, please. Help.

Description of issue: I received letter by mail dated April 19, 2023 welcoming me to the Federal Retirement System with an ID card with my CSA number on it. My pension is supposed to start next month (xxxxxxxxxxx). The letter says you will send me a password but it does not say how I will receive it and I have not received it. I tried to log in today to create an account, and it is very confusing. It gave me a screen that said I needed another password and not the one I just created for this account, so I tried to reset that password and it said that I have to contact you because it cannot be done online. Can you please provide me with specific instructions that I need to login and view my retirement account?
